My L2 EAD experience and how I got it without a biometrics appointment - Mission One Accomplished

**Update (05/05/2017) - Filing fee for form I-765 is now $410

I recently got my L2 EAD approved from USCIS. It took over 2 months for the entire process to complete. I researched a lot to make sure that I can have my work authorization in time. Although USCIS specifies that the process takes a maximum of 3 months, I read about many cases that took longer. I was very worried but fortunately, everything went well for my case. I am writing my experience and learning in this post, might be helpful for someone out there J

There are two options to apply for Employment Authorization: e-file or mail a paper application.

I applied using the second option - mailing a paper application. The reason I opted for the paper application was completely driven by my learning through different blogs and people’s experience at different sites. 
Later I got to know from some of my friends that they applied online and even they received the EAD in decent time. So can’t say if the paper application really works faster. But the one advantage I can surely write about in my case (paper application) is that I didn’t have to go for a biometrics appointment. I am guessing that since the documents and photos were submitted in hard copy with signature, biometrics was not required. Also, fingerprints are taken when entering the US for the first time at the port of entry. As far I know all the e-file applicants receive the biometrics appointment (if you have come across any exceptions, do drop me a link or note).

Here is the list of documents you need to submit for L2 EAD application:
  • USCIS Filing Fee of $410 – Cashier’s check
  • Form G-1145 (form to request e-notification when USCIS accepts your application)
  • Form I-765 (EAD form)
  • Copy of passport (Spouse and Self)
  • Copy of US visa (Spouse – L1 visa and Self – L2 visa)
  • Copy of I-94 arrival/departure record (Spouse and Self)
  • Copy of marriage certificate
  • Two (2) photographs (self)

I mailed my application along with above documents and a cover letter to USCIS through USPS Express mail service. This was the fastest method and cost me ~$20. And this was the only option of getting a signed acknowledgement of application receipt. You know, I was very careful with this application so opted for Express mail. You can choose to go with normal mail or courier also, whatever works out better for you.

My application was received by USCIS the very next day. I received an acknowledgment email and also a letter from USCIS after a couple of days. Everything seemed to be going great but then the wait began... I didn’t hear anything from USCIS for almost 60 days. Many of my friends got the biometrics appointment 1-2 weeks after submitting the application. 

I was concerned about the likelihood of incrementally long delays heron if the biometrics appointment is indeed compulsory. I tried calling the USCIS office a couple of times. They said my application is under normal processing time and I should wait for 90 days. If I still didn’t receive my card by then, I should immediately inform USCIS.

After doing little more research on the internet, I decided to write to Citizen and Immigration Services Ombudsman (cisombudsman@dhs.gov) asking their help to expedite my case so I can assume employment at the earliest. In response, I received an automated message suggesting to submit requests for case assistance through their Online Case Assistance (OCA) portal (https://cisomb.dhs.gov/oca/form7001.aspx). I didn't submit the request on the portal and decided to wait for some more time. I can't say if writing the mail to Ombudsman worked for me but fortunately, in a week's time my card was approved and I received my card without a biometrics appointment.

Here are the dates for your reference

21st May: Sent the EAD form-I765 and other documents through express mail
22nd May: Application received at USCIS office
28th May: Acceptance confirmation over email
29th May: Received the acceptance confirmation letter through the post
30th July: Mailed Citizen and Immigration Services Ombudsman
6th Aug: Application approved and status changed to “Post Decision Activity”
6th Aug: Status changed to “Card/Document Production”
10th Aug: Received the card

      1. You don't need to wait for SSN to apply for EAD. You can start this process anytime.
      2. I am not sure about the procedure to update address while the application is in process. If possible, you can give office address of the primary visa holder.

    I too have a similar case. I posted all documents with i765 application on 7th March 2014 by priority mail. On 13th March I received the acknowledgement of filing my application with the receipt number via e-mail . I was regularly checking my online status and gone with e-mail alert. On 25th March I applied online for asdress change as my L1 spouse moved from California to Iowa. On 27th March I got e-mail for address change. I even got the postal mail for the same on new address. On 7th April, I received e-mail notification of approval of my i765 application and another mail for new card production within 30 days. I am worried I didn't get any notification for my biometrics. I am worried if I missed some postal mails as I was in hotel for about a week. Also what's on ur Ead card in place of fingerprints? Is it stating that "fingerprints not available"?

    1. Megha, Good to know that your application is approved.
      Yes, my EAD card states "Fingerprints not available". As you submitted the paper application, you might have not got biometrics appointment like my case. Since your application is already approved, it should be fine.

    4. Hello Tyuio, yes you should use "express mail/courier delivery address". It's good to request delivery acknowledgement if possible and make sure you use right Lockbox address (Phoenix or Dallas) based on your location. Hope it helps!

We are just very confused whether or not we will be lucky enough to get an EAD approved for him. What is the rate of rejection vs EAD approval and job scenario if we get EAD? All the people i know with L2 visa have received EAD sooner or later. About the job, it depends a lot on your location and field/domain your husband is interested in.     I just wanted to thank you for sharing your experience - it was extremely helpful!

    I just received my card 10 minutes ago and it feels like heaven to have it in my hands... :-)
    Until last minute I was afraid that something could have gone wrong. And your blog mainly helped to calm my nerves and to keep my hair on. ;-)

    So here are my dates:
    June 10th, 2014: Sent the EAD form-I765 and other documents you mentioned with USPS Priority Mail
    June 11th, 2014: Application received at USCIS office (tracked by USPS)
    June 17th, 2014: Acceptance confirmation e-mail (thanks to form G-1145)
    June 19th, 2014: Received the acceptance confirmation letter (notice of action, acceptance date June 12th, 2014)
    August 26th, 2014: Status changed to “Card/Document Production”
    August 30th, 2014: Notification that card was mailed
    September 4th, 2014: Received the card

    So as you can see, less than 90 days for the total process. Which is apparently good compared to others. :-) No biometrics appointment, which I loved.

    To all my poor soulmates out there still waiting:
    Please, for your own sake, keep cool!
    I know, it is terrible to wait and to not know how and when this whole wait will come to an end. It is terrible to go to interviews and not to know when your papers will eventually be sent.
    Relax, go on holidays (it's no problem to leave the country), go on the job hunt or just enjoy those 3 months!
    Most important: Don't read those blogs and postings about ead cards lost by USPS or stolen by neighbours and people stressing themselves out if the card will come 2 days earlier or later. It's not worth it!

    Send the right papers, triple-check if you have everything in your application envelope and then enjoy your time.

  15. No Tel. You can,t. As when you arrive USA, a form I 94 is generated on your name. which is necessary to apply for EAD.
    But after applying EAD, you can go back to your country.

    I applied for it on 15th Oct and received the NOTICE OF ACTION (I-797C) on 17th Oct. Do I have to take some action after that like sending them a confirmation or something like that or just wait for the next confirmation from them.     I would need couple of information. It seems that once you apply for your EAD, the time taken to get it done is not constant by any means. It may vary from anything between 30 days to 90 days - as your experiences suggest. Now my question is, those who have gone to US in last year or so with an L2 in hand, for them how much time it took to get a job after receiving EAD. 3-4 experiences will help a lot, Thanks! - Avik

    Sep 20: applied n paid online. Got my case number

    September 22: sent the following docs in courier with the cover letter and the confirmation page I got after epayment.
    Mine n my husband's(L1 holder):-
    •Passport copy (front n back page, visa stamped page)
    •I94
    •copy of our marriage certificate
    •copy of my husband's job posting letter
    •2 copies of my photographs

    September 24:courier delivered

    Meanwhile I also created a login ID n registered to get the status in mail n mobile

    October 3: got I797

    October 6:got biometrics date

    October 8: address change done online

    October 16:biometric done

    December 17:case approved n card under production

    December 21:got approval mail

    December 24:card mailed

    December 26:card received:)

    Just be patient n your case will be approved within 90 days. Mine took 83 days to get approved n approximately 90 days to receive the card.

  23. Hi Shikha, thank you for sharing this informative post with the rest of us... it is so helpful... I checked the website and it says.. 380 as fees and 85 as biometeric fees.. a total of 465... so really confused... can you shed some light on this..

    1. Hi Suku, the biometric fee of $85 is only for eligibility category (c)(33) which is consideration of deferred action for childhood arrivals. There is no biometric services fee for any other employment category. Hope it helps.

      I have few questions to both of you. Please go through the steps below that I have planned and please let me know if all look good:


      1. I am planning to visit US under L2 visa taking 3 weeks leave from my current employer (in India). Right after reaching US(within 2 days or so) I am planning to apply for SSN and EAD simultaneously. Is this fine? I mean is there any interdependency between these two while applying?

      2. Suppose I receive SSN after 15 days post applying for the same (while I am still in US). Then I come back to India while the process for getting my EAD is undergoing. Is this fine as well?

      3. Once I come back to India I put my papers and serve the notice period to my current employer and go back to the US after 2/3 months(serving the notice period of course). Within this time-frame my EAD also arrives (as expected). Sounds fine?

      4. Now with NO current job in India can I start applying for jobs in the US using this EAD. Cool?

      5. If I go to US under L2 visa after completing the biometric in India, is it going take place again in the US? I guess not. 

      6. Lastly, it seems like once I apply for EAD upon reaching US its NOT mandatory for me to be present physically in the US during the processing time. Am I correct?

      As you can understand I am planning all these just to diminish the unemployment time as much as I can. I don't really want to sit idle during the processing of EAD which takes about 2.5-3 months. Instead I can spend the same time serving notice period to my current employer in India. Does this plan sound good? Or is there any glitches/risks involved with this? 


      Please let me know at the earliest so that I can plan accordingly. Thanks a ton in advance.

      Let me try to answer some of your questions based on my learning.

      1. Yes, you can apply for both SSN and EAD simultaneously. They are not dependent on each other.

      2. Based on my understanding it should be ok to go back to India after applying for EAD but i would recommend to check other blogs to learn from people with similar case.

      3. Yes, you can apply for jobs in US with L2 EAD.

      4. I believe that the biometric done for visa is separate than biometric for EAD. Since i got my EAD w/o biometrics, so can't say. My EAD card states "fingerprints not available", which kind of indicates that separate biometric appointment is needed for EAD.

      Yes, I spoke to some immigration attorney offline and they also said its fine to go back to your country after applying for EAD. But we need to make sure that in case bio-metric is scheduled we need to be present there to get it done. So that is the biggest question here. A lot of people said hard copy filing generally does not require a biometric to be done where as an online application does. Is this an established truth or just statistical data?

      Also if biometric has to take place generally within how many days it happens after EAD filing? 3-4 weeks?

    4. On 12 & 13 column of i-765 form the last arrival date and place to US were asked. Does that mean the recent travel detail or the previous travel date and place.

      1. You may not have an alien receipt number yet. You can write your name, dob and I-94 number on the back of your photo.

      2. Yes, you can start posting your resume. If you find a job and your EAD is not approved in the normal processing time, you may be able to raise a request to expedite your case.

      3. Your ead will be valid till visa expiring date. You can apply for renewal before the expiring data if your & your spouse's visa is extended.

      4. I entered the recent travel details in this section.

    1. Hi Queena, USCIS asks to write name and alien number on the back of the photo. Since many of us don't have alien number at the time of applying for L2 EAD, i suggested Nabanita (above post) to write name, dob and I94 number. Not sure, if it's a problem to not write the name and alien number. You may want to confirm with USCIS.

      1. You can buy the envelope from the post office. In fact, if you are sending the mail through express mail service, you would get it as part of this service.
      2. You may want to try CVS pharmacy or Walgreens.
      3. I got my EAD w/o biometrics, therefore no biometrics appointment for me :). I believe, they will send you the address in case you receive biometrics appointment letter.

      1. Yes, you can bring photos from India. You can find the specs in this document (page 7) - http://www.uscis.gov/sites/default/files/files/form/i-765instr.pdf

      3. If e-filing you should be able to pay the fee online. I mailed paper application and paid the fee through Cashier check.

    thanks for creating just a useful blog!

    i have some questions
    1. it's been more than 30 days i have applied for an EAD ,when i check the status of my case online it's still showing as case was received,i read other people's experience their application status is showing as "initial review"just after accepting the letter.
    2.if we start applying for jobs before getting an EAD?what do we fill in the section of application"are you legally authorized to work in US?..:) i am totally confused in this part.

      I hope by now you must have received your EAD. How many days it took for you to get EAD? Whendid your EAD card staus changed to "Initial Review" from "Case Received"?

      Its almost 15 days when I had submitted by EAD Card application, but status is still "Case Received". It did not change to "Initial Review".

    Feb 20 2015 : Sent the following Documents through FedEx.

    * Cover Letter
    * I-765 Application filled and Signed
    * G-1145 for E-mail and Phone Notification
    * Money Order for $380
    * My Passport copy (Front and back page)
    * My Visa Copy
    * My I94 Copy
    * My Spouse L1 Blanket Petition
    * My Spouse Passport Copy
    * My SPouse Visa Copy
    * My Spouse I94 Copy
    * Our Marriage Certificate
    * My 2 Passport sized Photographs.
    * My EAD Speed Up Receipt Notice (Which I received during my first EAD from USCIS).

    Feb 23 2015 : Package Delievered to USCIS, Phoenix (Through the Tracking Reference).
    Feb 26 2015 : Received E-mail and Message Notification from USCIS that Case has been Received and forwarded to Nebrasaka Service Center.
    Mar 04 2015 : Received I797 Receipt Notice through mail.
    Mar 31 2015 : Card ordered for Production.
    Apr 06 2015 : Morning - Status changed to "Card mailed to the Address"
    Apr 06 2015 : Evening - Status changed to "Card picked by USPS at origin facility and provided a tracking Number".
    Apr 07 2015 : Card Delivered.

    My total EAD processing time took 43 days.

    Couple of my Observations:

    1. Even though I sent G-1145, I received only Case Received email/message notification, No Notifications after that.
    2. There is a App called "USCIS Case Tracker". Install it in your smart phone/iphone and Add your Case Numbers. You get each and every notification about your case.
    3. For EAD Renewal, please save the Speed up Receipt Notice which we get with the first EAD. Guess it speeds up a bit.

    2. Can someone please help what this statement means?

      "If no prior EAD has been issued, you must submit a copy of a government-issued identity document, such as a passport showing your picture, name, and date of birth; a birth certificate with photo ID; a visa issued by a foreign consulate; or a national ID document with photo and/or fingerprint. The identity document photocopy must clearly show the facial features of the applicant and the biographical information."

      Do we need to submit an ID card along with the documents? Since I am new to US, I do not have any ID cards yet.

    I applied online for EAD on 16th March and sent out documents on 18th March. They received my documents on 30th March. But since then, there is no update. I did not get any e-notification or mail of their receipt of my application.
    I am pretty worried. What should I do?

    I am currently in India and will be travelling to US on L2 visa in the month of May and need to apply for EAD immediately.
    Q1: I have been to US few months back and got my I-94 that time so can I use it and apply right now from India itself? Since my husband is already in US i have the required information.
    Q2: Is it mandatory to have SSN before applying for EAD?

      1. I believe you should be in US to apply for EAD. I-94 is arrival/departure record and since you are already back in india, your I-94 will reflect that information.

      If I apply for EAD from US and then go back to India....and then come back to US after I receive my EAD. Will that EAD be still valid as my I-94 details would changed in the next visit even my visa details are same?
      I am planning to try this option so avoid the waiting time reqd for EAD so that meanwhile I can serve a notice period at my current company in India.

    3. Sumedha, Based on my understanding it should be ok to go back to India after applying for EAD. I would recommend to read avikju's response on my blog, he had same concern and had checked with immigration attorney or other blogs to learn from people with similar case.

      I have recently consulted with few US attorneys online and have found out that it is NOT mandatory to be physically present at the US once EAD is applied (and yet to be received by the candidate). However it is mandatory for you to stay for at least for a month (~) because if biometric takes place you should be present there. Now ideally biometric happens within 30 days of applying for the EAD. But its not guaranteed. Also in most cases biometric does not take place at all. So as you understand its completely a luck thing. You can ask a couple of free questions @ Avvo.com website to these lawyers to re-verify.

    I would really appreciate for the direction you have provided and to the people who have asked different questions that is making this portal a destination to stop by for all the information. There is no need to go anywhere and search for EAD information. My search for L2- EAD ends here.
    I am presently working here in MA on L1 B and my wife will come here for 2 weeks’ vacation. I am thinking to apply for L2-EAD for my wife but I am not sure whether 2 weeks is enough time to complete all dependencies on her. Although it takes max 90 days just wanted to confirm with you about how long her actual presence is required in this process as per your experience.
    1. Is having SSN mandatory condition before applying for EAD?
    2. Is 2 weeks enough time to submit I-765 online and get Bio metric scanning done?
    3. If I submit I-765 through paper form is there any probability to call for Bio metric Scanning?
    What do you suggest?

      2. I believe it might take longer than 2 weeks to get the biometric appointment notice.
      3. Not sure about the probability. I submitted paper application and didn't have to go for biometric.

    Background: L2 dependent visa holder and paper filed EAD for new card on April 6, 2015

    Question: I'm wondering if I'll have to go through the biometric test once again as I've already gone through this once in Jan 2015 while applying for Visa.

    Also, can anyone share the dates on when did they receive an Biometric appointment letter/mail and the actual Biometric appointment date. This shall help me know the buffer time we have to make the arrangements for commute to USCIS office.

    1. Sarika, I believe that the biometric done for visa is separate than biometric for EAD. Since i got my EAD w/o biometrics, so can't say. My EAD card states "fingerprints not available", which kind of indicates that separate biometric appointment is needed for EAD. All the best.

    Now, I am, may be in a unique situation.
    I had applied for an opportunity, I have got a green signal for.
    The issue is that confirmation is pending till the time I have some idea about the status of EAD.
    My application was received on March 23, I can access that online but there has been no change till date in the status.
    I wish to get my case expedited if that is an option.
    Can anyone suggest how ?

    1. You can try submitting request to expedite your case on Online Case Assistance (OCA) portal (https://cisomb.dhs.gov/oca/form7001.aspx). I believe, If you find a job and your EAD is not approved in the normal processing time, you may be able to raise a request to expedite your case. All the best.

    I applied for EAD at VSC. On Feb 18th, 2015 the application status was changed to "Initial Review". After that, the status has not changed at all. I neither received any biometric appointment too. Is biometric mandatory? What should I need to do process my application faster?

    My application was received on March 23, 2015. I have not received any appointment for biometrics. I wish to contact customer care and enquire about my case but when I call I am asked to enter my receipt number which is alphanumeric. I do not know how to enter alphabets while talking...so I have not been able to speak with anyone.
    It is quite annoying that after paying the hefty fees...things just come to a stand still and the applicants are left wondering when will the next step happen.
    Is this fair ?

    I had a question regarding my case status.

    My case was received by USCIS on May6th and status was 'Case received '.
    On July 6th,case status was changed to 'Case Was Approved' and:
    On July 6, 2015, we approved your Form I-765, Application for Employment Authorization , Receipt Number XXX. We will mail your approval notice.

    How long does it typically take after this status to receive the card,should case status change to 'Card production'?

    In the thread,I dont see this status posted by anyone.The next status I see is '“Card/Document Production” or “Post decision Activity” after acceptance confirmation.

    Anyone else seen this status and what was the time after this status to receive the card?It has been 60 days from the day case was received.
    Any help is appreciated.

      Status was always 'Case received' ,I did not check it for 2-3 days ,maybe it was different then.
      I received the approval notice by mail and it says I-766 was sent under separate cover.Case status shows 'Case approved' only.
      How long till I receive the I-766?

    This means the Recent Entry into the US ?? or Previous Entry... Kindly Clarify.

    2) Status at Last Entry : Do I need to mention current status : L2 Spouse ??
    3) Current Immigration Status : I don't understand the difference between Status at Last Entry and Current Immigration Status.

    4) Do I need to pay the Tax even if I am not employed.

      3. It can happen that you entered as H4 at the time of entry and converted to L2.

    Its time for me to give back my positive experience .

    I e-filed the form , for 2 reasons ,
    1) i know there can be no error from entering our names (still chances for error)long surnames
    2) i know a friend of mine who e-filed and got ead in 45 days.So basically e-filing and paper filing took almost same time.So was confident to go by e-file
    Still I know, I have to go for biometrics .

    Here are my time lines :

    may 27 - efiled and got receipt number, and I was asked to mail documents to vermont service centre
    may 28 - mailed the supporting documents (usps signature confirmation)
    may 30 - documents reached vermont service centre
    may 30 - i received receipt notice for efiling
    june 5 - got biometric appt letter for june 18
    june 8 - status showed "initial review"
    On June 8, 2015, we received your correspondence for Form I765, APPLICATION FOR EMPLOYMENT AUTHORIZATION, Receipt Number xxxx. We are reviewing your correspondence, and will mail you a notice if we need something from you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    june 10 - made a walkin and gave biometrics(As was out of state for the june 18 appt .I called service centre to postpone the appt.they asked me mail the notice back,so I asked can i postpone ar give biometrics on doing a walkin. They said its upto the ASC centre.I was clearly not sure ,whether they will accept my request , but i thought I will give a try. Only when no one was there for their appointment , around 4 pm ,they allowed me (long waiting time since morning 10am) , but were kind enough to accomodate.

    july 9 - status changed to "card was approved"
    on July 9, 2015, we approved your Form I-765, Application for Employment Authorization , Receipt Number XXX. We will mail your approval notice. Please follow the instructions in the notice. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    july 15- status changed "card was mailed to me"
    On July 15, 2015, we mailed your new card for Receipt Number xxx,to the address you gave us. If you do not receive your card by August 14, 2015, please go to www.uscis.gov/e-request to request that we send your new card to you. If you move, go to www.uscis.gov/addresschange to give us your new mailing address.

    july 15 -Received I-797 notice of action for application approval

    july 16 -Received card

    The more documents, the better ,in that way you know ,possibility of RFE is less

    I have sent the following supporting documents , along with the receipt confirmation page , i got when applied online.

    1)I-765 form
    2)L1 approval notice of spouse
    3)Copy of Passport (self and spouse)
    4)Copy of Visa (self and spouse)
    5)Copy of I-94 (self and spouse)

    18-Jun email received stating case received and fwded to Vemount Service center
    22-Jun letter received stating receipt date as Jun 15
    23-Jun Case received at USCIS
    10-Jul New Card Is Being Produced
    10-Jul Case was Approved
    16-Jul Approval Notice received
    16-Jul Status change to Card was mailed.
    17-Jul Status chnaged to card was delivered
    17-Jul Card received in mailbox

    i just wanted to know if anyone else received two EAD cards.
    I received one on July 15th and another one on July 20th.
    On July 15th,status was changed to'Card Was Delivered'.
    I have not requested for a new card,not contacted USCIS at all after receiving card.I stopped checking case status too.
    After I revived another card,checked the status.It says'On July 20, 2015, the Post Office delivered your new card'.

    Is this a problem?Should I check with them.
    The information on both cards match except for the card number at the back of the card at the top.

    I will include every detail so that I can help someone the way you helped me.

    Documents I included
    1.USCIS Filing Fee of $380 – Check
    2.Form G-1145 (form to request e-notification when USCIS accepts your application)
    3.Form I-765 (EAD form)
    4.Copy of passport (Spouse and Self)
    5.Copy of US visa (Spouse – L1 visa and Self – L2 visa)

    My (miracolous) time lines
    1st June I mailed it Send everything my mail and didnt register online. As recommended in this blog.
    9th Junr: I received email from USCIS saying its accepted
    This is the only email I got, The rest of the status updates I didnt get via email or sms.I however got ordinary mails in the postbox with all the updates. I checked the my case status in the USCIS link.
    11th June Got mail in my post box saying the same thing.
    30th June Case changed to Approved in the USCIS website
    6th jul: Card mailed
    10th july: Recieved Card

    One another thing I did, but no idea if it helped is on 10th June as soon as I got the email from the USCIS saying recieved application, I contacted my local congressman through his website. Gave him my EAC number and told him about my previous experience and current offer letter etc. They didnt reply. And I have no idea if it helped, but I would like to believe that it did.
    I also was never called for a biometric appointment, I also didnt have an SSN number while applying.

      Few of my friends commented that approaching local congressman is like double-edged sword... Some of the congressman are in favour to immigration and some of them may not..so picking up right local congressman could be prob...
      As Nasia followed this approach she can post comments/ her research or exp which will help others.

      Above comments are my just my understanding..its not hurt anyone or system or personal.

    5. I am so sorry no idea why I missed these posts. Hope I am not too late. I googled local congressman, and found the one in my zip code and sent him an email. that's it. They didn't reply but I got mine very soon. no idea if it helped. not attorney. it is congressman.

      We can apply for EAD online. I didn't. I applied by mailing the application form. That's what I meant by didn't do it online

      Website to find congressman., about them not liking immigrants. We are technically not immigrants. Don't u remember seeing non-immigrant visa. :-D we are NON immigrants here to work. Again I have no idea if it helped, but my time lines were much shorter.

      I got to know about my local congressman from the same website as you have mentioned. Upon contacting his team by email they sent me a "CASEWORK AUTHORIZATION FORM" over email. In there I need to fill up some information such as My Name, Address, SSN number, Case number with USCIS, the problem I am facing etc.

      I am asked to send the filled up form to his team over email/fax so that they can take necessary actions. Did you follow the same process?

  66. Congrats Nasia. It seems like you are very excited and thus have posted your experience quite a few times :-). But jokes apart, congrats one more time. One thing that stands out for sure, even before applying for EAD you got a job offer! Great indeed!

    I have heard a few cases where people have received job offer after applying for EAD but before receiving the same. But even before applying for an EAD, great job done indeed. Best of luck!

Hello All my name is sanjeev sharma i have some q like i got approved I797A (L1A) and my wife I797A(L2) we applied for SSN on june 30Th they said it will take 2 to 4 weeks and not today when i inquired they said our I 797A is not verified from home office i there any way i can contact home office to know the status and i wanted my wife to help me in my business for that i need EAD for here can you please advise how to apply EAD for her as she have approved I797A( L2 ) Thanks.

    1. paper filed l2 ead and
    2. had to go through biometric appointment.

    In most cases I saw e-filing required biometric appointment where as paper filing didn't. I want to know if someone has gone through both steps 1 and 2. Prompt response would help dearly.

      My friend did paper filing and he called for biometrics.
      So they may call for biometrics case by case.

  71. The blog provides very good insight and information that helps to file L2 EAD.
    During June 2015 using information and details in posts i filed L2 EAD.
    Now completed 70 days but status on USCIS website as "CASE RECEIVED" which is making nervous and worry. Spoke to USCIS Customer Care Executive (1800-375-5283) recently and understood from them that its required to wait till 90 days. If any body faced similar situation, kindly help with suggestions or leads which would definitely lift my spirits up.

    I am providing few details of my case,

    July 01 2015 -- Application received by USCIS on July 01 2015 (Docs sent to Phoenix AZ June 26 2015)
    July 06 2015 -- Received 'Notice of Action' from USCIS -- I-797C and given address as California Service centrer to contact for any queries.
    Case details on July 01 2015 -- "On July 1, 2015, we received your Form I-765, Application for Employment Authorization .........."
    Current status (Sept 07 2015) --- "On July 1, 2015, we received your Form I-765, Application for Employment Authorization...."
    So from 70 days no update in status.

      In my case, the status remained the same for almost 60 days. Once the application was approved, status changed to Post decision activity and then Card production on the same day. As per USCIS process, you need to wait for 90 days before you can escalate your case. Hope it helps.

    3. You will receive a call after 5-6 days from Ombudsman team regarding your query. Make sure you ask if 90 days is over whether you can visit the local ASC and if they will provide you with a temporary EAD till you receive a new one.

  74. I am sure this post has been helpful to many people including me. So sharing my experience (bad so far).

    Applied in 1st week of June 2015 this year (e-file)
    No status change/notification of biometrics appointment despite subscribing to e-notification. Did not receive appointment notice via mail also.
    Had scheduled an infopass appointment for regular case status check and fortunately then got to know about bio-metrics. Anyways, appeared for the same.

    Was asked to wait for 90 days every time i tried to query. In last week of 90 day, status changed to RFE issued. Was horrified when i saw RFE asked to same set of documents again, which were submitted with the application.
    Anyways responded to RFE and still waiting for the EAD after 110 + days.
    I am supposed to wait for 60 days after submitting RFE :(

    By infopass appointment, i mean meeting an immigration officer by appointment : https://infopass.uscis.gov//

    Immigration officer can tell you a little more about your case compared to what you see online or what you are told by phone agent.

  76. USCIS has started posting more realistic timelines on -"https://egov.uscis.gov/cris/processTimesDisplayInit.do"
    Earlier they would post only expected timeframe (e.g. 3 months)
    Looks like TSC is experiencing huge delay (5.5 months) in processing other (such as L2 EAD) I-765. God bless L2 EAD applicants !!!

      I went through the link you have provided but couldn't see anything that suggests USCIS is taking 5-5.5 months to process L2-EAD. Infact when I checked for processing timelines for Nebraska Service Center (where my case is undergoing) for L2-EAD i.e. all other I-765 it still shows 90 days. And this timeline is updated on 31st July 2015 i.e. the latest one.

      Anything I am missing out on? My application has been received some 38 days back by the USCIS. Please respond.

      where last column gives processing timelines as on July 31 2015,
      last time when i saw the processing timelines for i765 based on L visas shows as Jan 31 2015 (processing timelines updated till June 30 2015)

      I never understood significance of these dates and could not interpret them
      but worrying with statements given in link as "If the field office or service center is meeting its goal for processing a form, you will find the timeframe listed in months. For example, if the office is processing Form N-400 naturalization applications in five months or less, then the chart will say "5 months." However, if the office is experiencing a processing delay, you will find the filing date of the last case that the office completed before updating the chart."

      This scenario exists for Texas Center, California Center

      somebody can help me in interpreting quoted lines....

      As you noted, when the actual date is given in last column instead of timeframe (e.g. 90 days). This means the category is experiencing delays and the last case completed at the time of generation of this table (31st July) was the one submitted on 28th Feb. This is 5 months- a worrying sign...I also checked this table sometime back and it had had 5.5 months gap. So i hope they are catching up...

    As some of them are experiencing processing delays on their I 765 (going through pain), I want to provide details which are interesting regarding when can Immigration officer can pick up your Form for processing (Guesstimate)...(myself not convinced on this theory and have lot of questions )

    Lets look at theory ...
    1. Take your Receipt number
    2. Browse link https://egov.uscis.gov/casestatus/landing.do sign up for an account
    3. once logged in enter Receipt numbers above & below yours (do search for 10 records above & below of your receipt numbers) check history of each case, this will give some fair idea that how other cases are being processed.. based on these details you can come up with rough idea about your case.

    Questions that popup on my mind after applying theory..
    1. Don't know from which service centre they are processed
    2. Time-lines mention will not be matching with "https://egov.uscis.gov/cris/processTimesDisplayInit.do"
    3. Not sure if processed 'I-765' are based on L2 or GC based application

    I am sure theory mentioned above have flaws but it will give some relief to L2 EAD applicants that some thing is happening around their case (I know that most of them are interested about their application :) ).

    *** Fundamentally above theory is based on assumption that... Each application processed by each Service Center in order they received.

    I have few things to say/ask regarding the 3 questions that you have posted above.

    1. "Don't know from which service centre they are processed" : I guess, it is mentioned in the case status itself right? When you go to the page https://egov.uscis.gov/casestatus/landing.do and enter your receipt number it tells you that YOUR CASE WAS RECEIVED and the application has been forwarded to XYZ service center and all. So you may get it here right?

    2. "Time-lines mention will not be matching with https://egov.uscis.gov/cris/processTimesDisplayInit.do" : what do you mean by that?

    3. "Not sure if processed 'I-765' are based on L2 or GC based application" : thats true. It might take longer for GC applications. Which can't be identified from the case status page.

    But couple more questions that I have are:

    1. This searching for 10 records above & below of my receipt number MAY only work when it is pending for more than 75 days right? Because anything like 40-45 days (which is my case) will always be CASE WAS RECEIVED. Right?

    2. Any of your friends/known person have applied for an L2-EAD recently? And what was his/her service center and processing times?

      I don't think any restriction like that, saw some case history which got EAD with in 45 days.

      So I assume its already been more than 75 days since your case was received by the USCIS. In the following page it says clearly "You can now submit inquiries about the status of your Form I-765 after your case has been pending more than 75 days.".

      Its app. 70 days.
      I think once 75 days are complete then USCIS accepts SR.
      After going through so many reviews and comments, have a feel that raising SR or Info pass will not be helpful
      just waiting for some responses on Congressman stuff... if gets some details, i think this will be much better approach.

      May be sometimes having more information and multi approaches confuses lot & will not able to decide which will be better way etc.

    If possible at-least cover the experiences which includes like,
    1. Difference between Senator Office vs Congressman office
    2. Irrespective of ideologies on Current Immigration Policies will the Offices work (At the end of day because of not favouring Immigration it should not make more delays)
    3. If we have Offer letter and waiting for EAD.... sending offer letter to Immigration office or Congressman or Senator is it going to help.

    I received L2 EAD card on Sep 24 2015. Finally stars shine on me and card received on 76th day.
    Not sure if sending documents to congressman on Sept 18 2015 helped to get card or speedup process.

    Check-list of documents sent for filing of EAD
    Below list of documents finalized after going through good number of blogs
    USCIS Filing Fee of $380 – USPS money order
    Form G-1145 (form to request e-notification when USCIS accepts your application)
    Form I-765 (EAD form)
    Copy of passport (Spouse and Self)
    Copy of US visa (Spouse – L1 visa and Self – L2 visa)
    Copy of I-94 arrival/departure record (Spouse and Self)
    Copy of marriage certificate
    Two (2) photographs (self)
    Photos (2) of marriage
    Bank statements

    Dates for reference how things went,
    05th July: Sent the EAD form-I765 and other documents through USPS Priority express mail (has facility of ACK)
    10th July: Application received at USCIS office
    14th July: Acceptance confirmation over email
    18th Sep: Sent documents through Congressman
    21st Sep: Application approved and status changed to “Post Decision Activity” and evening status changed to Card mailed
    24 Sep: Card Received
